UWF的 第九条政策 covers sexual misconduct, 性暴力, and gender-based discrimination.  

第九条 of the Education Amendments of 1972 was the first comprehensive federal law to prohibit sex discrimination against 学生 and 员工 of educational institutions. It is one of several federal and state antidiscrimination laws that define and ensure equality in education.  第九条实施条例, 1975年出版, 禁止歧视, 排除, 否认, 限制, 或者基于性别的分离.  

第九条 states: No person in the United States shall, 以性别为基础, 被排除在…之外, 被剥夺…的利益, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.

All UWF 学生, 教师, and staff are protected under 第九条.

Students or 员工 who feel that they have been victims of sexual misconduct, 性暴力, 或者性别歧视, 或者目睹过, 应该尽快提交报告吗. 有多种方法可以提交报告:

The University respects the private nature of reports. If a student or employee discloses a 第九条 allegation to a Mandatory Reporter they should expect that, beyond the required notification to the 第九条 Coordinator, 该报告将保密.

The University also must statistically report the occurrence on campus of major violent crimes, 包括某些性犯罪, 在一个 综合年度保安及消防安全报告 校园犯罪统计数据. This statistical report does not include personally identifiable information.

If the University believes there is an ongoing threat, University Police Department may issue a “Timely Notice” through the Argo Alert system. If the 发牢骚的人 does not wish to pursue any remedy under the 第九条政策 and/or requests that his or her complaint remain confidential, University will consider the 发牢骚的人's request. 然而, University is required to investigate and take reasonable action in response to information received as part of the investigation. The 第九条 Coordinator will weigh the 发牢骚的人's request against the following factors:

  • Whether there have been other complaints of sexual misconduct, 性暴力, 或者性别歧视 against the same 被调查者.
  • Whether or not the accusations are of a nature that the continued presence of the 被调查者 on campus poses a threat to the safety of other community members.

The 第九条 Coordinator will inform the 发牢骚的人 if the University makes the determination to move forward with charges under this 第九条 policy without the 发牢骚的人's participation.

There are only two areas where 学生 and 员工 can find confidential assistance: 

  • 学生辅导及心理服务 (CAPS) are the only 员工 on campus able to provide confidential support. 
  • 员工员工援助计划 through Human 资源 can provide confidential counselors in the community to provide assistance.

There is no time limit or statute of 限制s to make a report of 第九条 allegations. 不过, 学生 and 员工 are encouraged to report alleged 第九条 violations immediately in order to maximize the University's ability to obtain evidence and conduct a thorough, 公正的, 可靠的调查. Failulre to promptly report alleged 第九条 violation may result in the loss of evidence and witness testimony and may impair the University's ability to enforce the 第九条政策.

Yes, if you want formal disciplinary action to be taken against the alleged 被调查者.  

If the student or employee does not wish for formal disciplinary action to be taken, but still wants to make a report and seek assistance, a complaint may be filed without naming the alleged 被调查者. 然而, 发牢骚的人s should be aware than not identifying the 被调查者 may limit the University's ability to respond 在一个 comprehensive manner.

第九条 allegations are serious and the 被调查者 has the right to know the allegation(s).

发牢骚的人s are not required to file a formal complaint in order to receive assistance. During an intake meeting, 第九条 staff will review all options for accommodations and resolution. Our main priority is to verify your safety and provide immediate relief options to ensure your continued participation in University programs and activities. 如果是在入学会议的时候, 你不确定你可能需要什么样的帮助, you can always consider your options and communicate your request to 第九条 staff at a later 日期.
